Are Vacation Rentals Allowed at the Palms at Wailea?

The Palms is an apartment-zoned condominium complex where owners can vacation rent due to county ordinance. The County of Maui recently passed Bill 9, which would sunset short-term rentals in the apartment district. As things stand, vacation rentals would be prohibited at the Palms after January 1, 2031.

However, the new law is facing lawsuits. The Maui County Council also passed Bill 88, this created two new types of Hotel Zoning, H3 and H4. The new zoning would be equivalent to the current A1 and A2 districts, with one critical difference: the right to vacation rent. Bill 88 provides a path for condos like the Palms to continue to offer short-term rentals.

The County Council also recently passed resolutions that started the rezoning process for several Maui condos. The Palms at Wailea was included in Resolution 26-111. At this point, there are no guarantees on the rezoning process. We should know more about the Palms and other condos in Fall 2026.
