Can Kapalua Bay Villas Condos Be Vacation Rented?

Bay Villas currently allows vacation rentals. However, it is Apartment-zoned, and the County of Maui recently passed Bill 9. This new law phases out short-term rentals at apartment-zoned condos in West Maui by January 1, 2029. The bill is being challenged in the courts. There is also proposed legislation that would create two new hotel zoning categories. If the zoning is created, Apartment Zoned developments could apply for the new zoning and, if approved, continue to allow vacation rentals. Kapalua Bay Villas was recommended as a candidate for the new zoning by a committee of the Maui County Council.
