Can Kapalua Bay Villas Condos Be Vacation Rented?

Bay Villas currently allows vacation rentals. However, it is Apartment-zoned, and the County of Maui recently passed Bill 9. This new law phases out short-term rentals at apartment-zoned condos in West Maui by January 1, 2029. The bill is being challenged in the courts. The county council also passed Bill 88, companion legislation to Bill 9, that created H3 and H4 zoning. The two new zoning categories are identical to A1 and A2 zoning with one key distinction: the right to vacation rent.

Kapalua Bay Villas was recommended as a candidate for the new zoning by a committee of the Maui County Council. The county council has also started to pass Resolutions initiating the rezoning process. While it is thought that Bay Villas will be included in a resolution at some point, it is not going through the rezoning process yet.
